The Court obliged the Staff of the Prime Minister to provide “Path of law” NGO with the so-called secret decision on bonuses awarded to public officials and public servants

On 10 March, 2020, the Administrative Court of the Republic of Armenia decided to grant the claim of “Path of Law” NGO against the Office of the Prime Minister, obliging the Staff of the Prime Minister’s to provide the decision on bonuses awarded to the Ministers, Deputy Ministers, Secretary-Generals of the Ministries and Governors.

Yet in October 2019, an information was leaked that the Prime Minister, against the law, gave secret instructions to double the salaries of high-ranking public officials.

On 23 October 2019, during the NA-Government question-and-answer session Nikol Pashinyan, Prime Minister of Armenia, confirmed the existence of such document, but claimed that it has stamp “secret” and cannot be open for the public.

On 30 October 2019, “Path of Law” NGO asked the Staff of the Prime Minister to provide a copy of the document.

On 6 November 2019, the Staff of the Prime Minister declined to provide the requested information, arguing that the decision in question contains a confidential information.

On 6 December 2019, “Path of Law” NGO, filed a lawsuit in Administrative Court against the Office of the Prime Minister to oblige the latter to provide the information requested on 30 October, 2019.

The Administrative Court of the Republic of Armenia has stated that the public has the right to be informed about the remuneration of officials in addition to the ones regulated by the law, as the restriction of the mentioned information has no legitimate purpose.
